Important NFA Update — October 2026
On October 9, 2026, ATF announced significant changes to its enforcement of National Firearms Act requirements.
Under this guidance, eligible suppressor purchases may now be completed without mandatory ATF Form 4 approval or NFA registration.
Customers must still complete the required firearm transfer paperwork, background checks, and comply with applicable federal, Florida, and local laws, including waiting periods.

Understanding NFA Requirements
Effective January 1, 2026, the federal making and transfer taxes for suppressors, short-barreled rifles (SBRs), short-barreled shotguns (SBSs), and Any Other Weapons (AOWs) were reduced to $0.
This means eligible suppressors may be transferred without mandatory ATF Form 4 approval or NFA registration. However, federal firearm transfer requirements, background checks, and applicable state and local laws still apply.
The National Firearms Act has not been repealed. Machine guns and destructive devices remain subject to existing NFA requirements, including applicable taxes, registration, and approval.
What is an NFA Item?
An “NFA item” refers to a firearm or firearm accessory that is regulated under the National Firearms Act (NFA), which means it requires specific legal steps to purchase, own, and transfer, including registration with the government and obtaining a tax stamp; common examples of NFA items include machine guns, silencers, short-barreled rifles, and short-barreled shotguns.
How do I send my NFA transfer to Apex?
Please fill out our transfer form and we will send your dealer our FFL and SOT. They will then ship us the NFA item and we will complete the process outlined below to transfer it to you.
How much does it cost to purchase an NFA item?
While the price of the actual firearm or suppressor can vary dramatically, the taxes and fees are the same.
- NFA Tax Stamp – As of January 1, 2026, the $200 tax stamp fee has been removed for most NFA items, including suppressors, Short-Barreled Rifles (SBRs), Short-Barreled, Shotguns (SBSs) and Any Other Wespons (AOWs). The fee remains for any transferrable machine gun. If you are required to pay a tax stamp, we will asssist you with paying it.
- FDLE Background Check Fee – $5. This fee applies to all firearm purchases and is a pass-through fee that we get charged to run a background check.
Can I voluntarily register my suppressor with ATF?
Under ATF’s October 9, 2026 guidance, NFA registration and Form 4 approval are no longer mandatory for eligible suppressor transfers under the current federal nonenforcement policy.
Customers who prefer to register their suppressor voluntarily may still choose to use the traditional ATF registration process.

How do I purchase a suppressor (or other NFA Item) from Apex?
Purchasing an eligible suppressor is now more straightforward under ATF’s updated October 2026 guidance.
Choose Your Suppressor: Browse our available suppressors or visit our Silencer Shop online store.
Visit Apex: Our team will help you with the purchase and explain the applicable requirements.
Complete Form 4473: Fill out the required federal firearm transfer paperwork.
Background Check: Complete the required FDLE background check and satisfy applicable eligibility and waiting-period requirements.
Complete Your Purchase: Once all legal requirements are satisfied, our team will finalize the transfer.
ATF Form 4 approval and NFA registration are not mandatory for eligible suppressor transfers under the current federal nonenforcement guidance. Voluntary registration remains available.
ATF Eforms Account Instructions
To finish your NFA purchase and complete your ATF Form 4, you will need an ATF Eforms account using the same email address as your Silencer Shop account. If you do not have an account use the instructions below to create one.
To create an account:
- On your computer, visit https://eforms.atf.gov/
- Click the green “Register” buttonFill out the registration form using the same email and phone as your Silencer Shop account.
- When you get down to PIN, create a 4 digit PIN and write it down – you will need it in the certification process.
- After creating the account, click on the “My Profile” tab.
- Make note of the username, which is 6 characters of your name then 5 random numbers. For example Mr. Johnny Silencer’s username would be something like JSILEN98765. Also note that this is different from the email address “username” that you use to log into eforms.
If you already have an account:
- Visit https://eforms.atf.gov/ and log in.
- Click the “My Profile” tab.
- Make note of the username, which is 6 characters of your name then 5 random numbers. For example Mr. Johnny Silencer’s username would be something like JSILEN98765. Also note that this is different from the email address “username” that you use to log into eforms.
- If you know your 4-digit PIN, then all good. If not, click on the “Password/PIN/Security” tab and scroll down to “Forgotten PIN”. Follow the instructions to create a new PIN and write it down.
